Introduction

            This page states the "Terms and Conditions" under which this Web site is governed. By using this Web site, You accept these Terms and Conditions and agree to be bound by them. Should a change to these Terms and Conditions occur, those changes would be reflected on this page so that You are always informed.

 

Terminology

            The terms "You", "Your", and "User" as used herein refer to all individuals and/or entities accessing this Web site for any reason. Those who post a job opportunity on IWantToMakeIt.com are referred to as a "Client" and those who post a resume are referred to as "Contractor." Note that, as used herein, the term Client refers to someone who hires a Contractor, and does not refer to clients of IWantToMakeIt.com.

 

Overview

            IWantToMakeIt.com is a website that helps you find people with the skills you need to make something. You approach the site asking the question "what do I want to make?"  The site provides a variety of Categories to help you answer that question.  The categories are broken down to specific subjects. For example, if you want to make a board game, go into the Entertainment and Games Category and you will find Resume Advertisements of professionals that make games. You may inspect Resume Advertisements found under the categories or subjects. The Resume Advertisements help you to decide whether or not to pursue contacting the advertised individuals. When you decide to contact them, the site also provides forms for requesting estimates and keeping track of whom you contacted. 

            You may also allow people to bid on your job.  The bids may be accompanied by a Resume Advertisement of the bidder so that you can evaluate their qualifications as well as their bid.  Easy to see information is presented on the Resume Advertisements from business information to qualifications to sample images.

            The site also allows free job posting.  These job postings are useful and the site allows professionals to bid on the job postings.  IWantToMakeIt.com allows easy management of your job and the ability to review all your bids and submitted Resume Advertisements that come along with the bid so You can get more information on the bidder.

           

Goals

            The site has two main goals.  The first goal is to easily present Client and Contractor data and opportunities. These come in the form of posted jobs and resume advertisements. The second goal is to manage the contacts that may come about from the postings.

            When job bidding is over, and the job is labeled closed, the Client who posted the job will have a list of those who bided on it and how to contact them.  It is up to the Clients to contact the Contractor and make a business deal.  Our system just helps bring the Contractor to the Client.

            Same thing goes when Clients approach a Contractor through their posted resume.  The Contractor gets the Client�fs contact information and must conduct further contact on their own.

           

User Types

            Lead (User) –These are users that have come upon the site and proceed to view it without contacting us or signing up in any way. 

            Client account (Client) – A client account will be a simple account currently slated to be free of charge.  Clients can post jobs and request estimates from Professionals.  On the site, the color of Red symbolizes everything relating to Clients.

            Professional account (Contractor) – A professional account is the full service account that requires a monthly fee.  Besides having all the abilities of a Client account, they can also post Resume Advertisements and bid on jobs.  On the site, the color of Blue symbolizes everything related to Professionals.

 

Signing Up

            When visiting the site without logging in or before registering, You are an unregistered user or "lead."  When You sign up, we gather Your basic information and verify Your email address by sending You an email with an activation link in it.  Once You get that email and activate Your account, You have a Client account.  Based upon whether You originally clicked on the option of signing up for a Professional account or not, You are either automatically directed to the Professional signup section or given an advertisement for the Professional account.  Once in the Professional signup steps, You are asked what type of account You want, which allows You to choose between prices and aspects such as the maximum number of resumes You will accept.  The next step allows You to enter Your credit card information and complete the signup process. 

 

Subscriptions

            Professional level subscribers are entitled to post Resume Advertisements and to bid on job postings.  Client level subscriptions do not permit Resume Advertisement posting nor job bidding. 

            Client and Professional members will be billed for subscription payment on the first of the month.  If You quit during a paid-up month, You will continue be able to access the site for the remaining time of the currently paid month.  IWantToMakeIt.com will not give a refund for unused remaining time, nor will IWantToMakeIt.com pro-rate the subscription payment for a subsequent new subscription.

            IWantToMakeIt.com may terminate Your subscription at any time at its sole discretion.  After such termination, IWantToMakeIt.com may, at its sole discretion, contact You and ask You to sign up again. 

            You must provide current, complete and accurate information for your billing account. You must promptly update all information to keep your billing account current, complete and accurate (such as a change in billing address, credit card number, or credit card expiration date), and you must promptly notify IWantToMakeIt.com if your payment method is canceled (e.g., for loss or theft) or if you become aware of a potential breach of security, such as the unauthorized disclosure or use of your user name or password. If you fail to provide IWantToMakeIt.com any of the foregoing information, you agree that IWantToMakeIt.com may continue charging you under your billing account unless you have terminated your account (confirmed in writing upon request).

 

Limitations of Liability

            IWantToMakeIt.com is not responsible for any of the obligations entered into in a contract between a Buyer and Supplier. IWantToMakeIt.com does not warrant or guarantee the performance of Contractors or the outcome of the use of the IWantToMakeIt.com system to identify Client needs. IWantToMakeIt.com is not the agent or employer of a Client or Contractor. IWantToMakeIt.com has no interest or control over any Client or Contractor using its services. IWantToMakeIt.com does not guarantee and is not responsible for the accuracy of information provided by Leads, Clients or Contractors. IWantToMakeIt.com is not liable for the actions of, failures to act, or the services sought or provided by Client or Contractors through IWantToMakeIt.com. IWantToMakeIt.com is not a party to any contract for services between Clients and Contractors and is not responsible for any of the obligations of parties to such contract.

            No web site can guarantee continuous and uninterrupted availability.  You agree that IWantToMakeIt.com shall not be liable, and You agree to hold IWantToMakeIt.com harmless, in the event of the web site being down or inaccessible to You for any reason.

            IWantToMakeIt.com will not be liable for any damage, loss or disclosure of data, accounts, revenue or business arising out of or otherwise related to: (a) Your use of the web site, its services or products; (b) errors, bugs or other defects in the web site; (c) lost information (e.g., billing information, credit card numbers, etc.), or information lost (e.g., identity theft) due to action or inaction of a third party such as a credit card company; (d) illegal or criminal activities, including but not limited to reliance on any information obtained on the web site; or (e) or that result from mistakes, omissions, interruptions, deletion of files or e-mail, loss of or damage to data, errors, defects, viruses, delays in operation, or transmission, or any failure of performance, whether or not limited to acts of God, communications failure, theft, destruction or unauthorized access to IWantToMakeIt.com records, programs or services.

            IWantToMakeIt.com is not liable for Your transactions with Your Clients or Contractors, or the use of their information, or for any other actions arising from Your use of the web site, or the use of other parties to whom You have given access to Your account information, through the use of the web site.

            IWantToMakeIt.com is not involved in any transaction between You and Your Client  or Contractor or other third parties; or between You and any user of any products or services offered or provided by You or by a third party through the web site.

            IWantToMakeIt.com is not responsible for screening, censoring or otherwise controlling any listings or transactions offered or conducted via the web site. You are deemed to have a direct commercial relationship with each third party that undertakes any transaction with You via the web site. IWantToMakeIt.com is not acting as Your or any third party's agent in connection with the web site. You are solely responsible for Your interactions with Clients or Contractors.  Further, because IWantToMakeIt.com is not involved in any of these transactions, IWantToMakeIt.com cannot and will not be involved in resolving any disputes relating to any completed or uncompleted transactions.

 

Web Site Content

            You acknowledge that all rights to the content of and information provided on this Web site, including copyrights, are owned by IWantToMakeIt.com. You hereby grant IWantToMakeIt.com the ability to refer to You by Your corporate name for the purposes of marketing and potential case studies without requiring prior notice of or consent by You for such use. You understand that IWantToMakeIt.com's Web site contains links to third parties' Web sites ("Third-Party Sites") that are not under the control of IWantToMakeIt.com. IWantToMakeIt.com is providing these links to You solely as a convenience and is not responsible for the content or functioning of any Third-Party Site. The inclusion of links to Third-Party Sites does not imply any endorsement by IWantToMakeIt.com of the operators of such sites or the products or services offered on the Third-Party Sites. You are responsible for understanding and abiding by the terms and conditions of use required by all Third-Party Sites. You agree that IWantToMakeIt.com is not liable for the use, loss or theft of Your personal information, including credit card information, as the result of the action or lack of action on the part of any third party.

 

Governing Law and Venue

            This agreement shall be governed by and construed under the laws of the State of Texas. Venue and jurisdiction shall be in Austin, Travis County, Texas, USA.

 

 

 

Site Use Obligations.

            IWantToMakeIt.com reserves the right, at its sole discretion, to terminate Your account or restrict Your access to the web site without notice for Your violation of any of the following obligations. You agree You will NOT do any of the following while using this site or any of IWantToMakeIt.com's services:

 

A. Violate any applicable law, code or regulation;

 

B. Post or transmit any content that You do not have the right to post or transmit under any law, agreement, contract, or relationship;

 

C. Post or transmit any information or content that infringes a third party's intellectual property rights or rights of privacy or publicity;

 

D. Post any information that is libelous, defamatory, vulgar, obscene, hateful, harmful to minors, racially or ethnically objectionable, abusive, tortuous, threatening, pornographic, or overly disparaging, critical or deprecating of or to IWantToMakeIt.com or other users, or is otherwise objectionable;

 

E. Conduct any business or activity, or solicit the performance of any activity, that is prohibited by law or is not consistent with this Web site's intended use as determined by IWantToMakeIt.com in its sole discretion;

 

F. Resell any of the information or services provided by IWantToMakeIt.com or otherwise misrepresent that any information or services provided by IWantToMakeIt.com are provided by You;

 

G. Restrict or inhibit any other user from using this Web site or any related services or deleting or tampering with the postings of other users;

 

H. Post false or misleading information about You, You company, or You services, impersonate or misrepresent You, You company, or You services, or create a false identity for the purpose of misleading others;

 

I. Use the Web site or any IWantToMakeIt.com service or information in connection with surveys, contests, pyramid or multi-level marketing schemes, distributorships, club memberships, chain letters, spamming or unsolicited messages;

 

J. Upload files that contain software or other materials in violation of the intellectual property or privacy rights of others, that contains viruses worms, corrupted files, or any other machine-readable command, program or information that may damage another user's property or the operation of IWantToMakeIt.com or their computers;

 

K. Take any action, which would impose or create an unreasonable or disproportionately large load on this Web site's infrastructure, including Denial of Service;

 

L. Use You password access for any unauthorized purpose or access, tamper with or use non-public or non-authorized areas of the web-site;

 

M. Solicit, harvest or otherwise collect information about other users, including their names, e-mail addresses, physical address, telephone, and the like without their express consent or for any commercial or business purpose or to transmit unsolicited advertising or communications; or

 

N. Post any of Your personal contact information in any descriptive text field found in Jobs, Bids, Resume Advertisement and Estimate requests unless otherwise permitted.
